Article 1 - Object

The terms and conditions of sale herein govern by SAS Mike Services R.P.P.A., located at 45 Grand-Rue, Saint-Paul-Lez-Durance, 13115, France from Retail Automobile Equipment (APE: 4532Z)

Article 2 - Price

Prices of our products are indicated in euros, all taxes included (VAT and other taxes are applicable on the date of the order), unless other mentioned but excluding processing and shipping costs.

In case of ordering to a country outside of Metropolitan France, you must check for more information if customs duties, other local taxes, import duties or state taxes may be added. These duties are not the responsibility of Mike Services but these will be your responsibility. Your competent authorities will advise you about terms of declaration and payment, we suggest you to find out about these aspects from your local authorities.

All orders are payable in euros regardless of their origin. Mike Services company reserves the right to change prices at any time, but the products will be billed based on the rate in effect at the time of validation of your order. The products remain the property of Mike Services until full payment has been received. Warning: as soon as you physically take possession of the products, the risk of loss or damage to the products is transferred to you.

Contract information is presented in English and it will be confirmed during validation of your order. Mike Services reserves the right neither register a payment nor confirm an order for any reasons especially in case of supply problem or difficulty of an order.

Article 4 - Validation of your order

Any orders appearing on http://mike-services.com website adhere to these terms and conditions. Any order confirmation implies your full and complete adhesion to the conditions of sale without exception. All data and confirmation will be a proof of the transaction.

You declare to have perfect knowledge of all processes. The order confirmation will be signed and acceptance of the operation will be carried out. The summary of your order information and these terms and conditions will be sent to you via email address of your order confirmation.

Article 5 - Payment

The fact of validating your order implies the obligation to pay an indicated price.

Payment options:

  • Credit card, Visa, Master card, Maestro, American Express, Carte Aurore, 4-Star card, Cofinoga, etc.

Article 6 - Retraction

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have right to withdrawal without having to justify any reasons or to pay penalty within 7 days of the date you receive the product. Returns must be made in their original condition and fully complete (packaging, accessories and instructions). In this context, your responsibility is engaged.

Any product damage may be defeat the right of withdrawal. Return costs are entirely the responsibility of customers and the costs are not refundable. In case of withdrawal, Mike Services will refund the paid amounts, excluding shipping, within a maximum of 14 days after the notification of your request and normally via the same payment option of your purchase.

Exceptions to the right of retraction:

In accordance with the provision of ArticleL.121-21-8 of the Consumer Code, the right of withdrawal does not apply to; 

  • The provision of services are fully performed before the ending of the withdrawal period and execution begins after consumer consent and waiver the right of withdrawal.
  • The supply of goods or services that prices depend on fluctuation in the market beyond the control of the professional and likely to occur during the withdrawal period.
  • The supply of goods is made to consumer specifications or clearly personalized.
  • The supply of goods may deteriorate or expire quickly.
  • The supply of goods has been unsealed by the consumer after delivery and cannot be returned for hygiene or health reasons.
  • The supply of goods is inseparably mixed with other products after being delivered and by their nature.
  • The supply of dangerous products is deferred beyond 30 days and agreed at the conclusion of the contract that period of time depends on fluctuations in the market beyond the control of the professional.
  • The supply of audio, video recording or computer software has been unsealed by the consumer after delivery.
  • The supply of newspaper, periodical or magazine except for subscription contracts to these publications.
  • Transactions conclude during a public auction.
  • The supply of digital content that is not provided on a physical forms withdraws before the ending of the withdrawal period and execution begins after consumer consent and waiver the right of withdrawal.

Article 7- Availability

Our products are offered as long as they are visible on http://mike-services.com website and within the limit of available stocks. For non-stock products, our offers depend on the availability of our suppliers. In case of unavailability of product after placing your order, we will notify you by email. Your order will be automatically cancelled and bank debit won’t be made (if the payment has been made by Paypal, you will be refunded immediately).

In addition, https://mike-services.com website is not intended to sell its products in large quantities. As a result, Mike Services Inc. reserves the right to refuse the orders that contain too many identical items.

Article 8 - Delivery

Products are delivered to the delivery address that indicated during the ordering process, within the period of time on the order validation page.

Legally, Mike Service R.P.P.A. company has the right to ship your package up to 7 business days after receiving your payment, however all items are usually sent within 1-2 business days. If the order was placed before 5 p.m., some items will be sent on the following day. In case of shipping delay, we will inform you the possible delivery date by email or phone call. The entire order process can be followed in your personal space under the title “my account”. In accordance with the legal provisions, you have the possibility to cancel your order under the terms and conditions defined in Article L 138-2 of the Consumer Code in case of late delivery.

If in the meantime you receive the product, we will proceed to its reimbursement and shipping costs under the condition of Article L 138-3 of the Consumer Code. In case of delivery by a third party carrier, Mike Services Company cannot be held responsible for late delivery due to unavailability of the customer after several appointments. Mike Services Company cannot be held responsible for any loss or damage to products shipped by carriers. Most of our products benefit from carrier insurance. Sending items abroad may be subject to customs formalities, depending on the declared value.

If you import French goods into your country of residence, you are required to verify that import of your product complies with the national and local laws of your country. Import laws may vary according to objects and the countries where buyers and sellers live. It is your duty to inform about all the conditions. Mike Services will provide you an invoice and declare the value of the items, but we won’t be liable for any additional import charges.

  1. Trade in the European Union: you won’t have to pay taxes and duties for your purchases on http://mike-services.com website. Businesses and individuals operating within the European Union, the European Economic Area (EEA) and Turkey have to right to import and export goods freely. Therefore, quantities of import and export cannot be restricted and no import charge for the member countries of the European Union.
  2. Overseas: If the countries are part of customs territory of the European Union, they are considered in tax terms as third territories, including their relations with Metropolitan France. Thus, exchanges between each DOM and Metropolis or any member countries of the European Union are considered case by case (see special cases: in Martinique, Guadeloupe, Saint-Martin, Mayotte, St. Barthelemy, Guyana and Reunion). Self-governing and specific governing overseas communities, please contact your local authority for more information (see special cases: in island of Saint-Martin and the island of Saint Barthelemy).
  3. Trade outside the European Union and international: The customs duty or customs tariff is a tax on imported goods when it passes through the border. These fees may be fixed or represented a percentage of the price. Seller must declare the value of the object and comply with the current law of customs declarations. Buyers may have to pay additional customs duties. You must check before ordering if import products are subjected to a customs duty.

Article 9 - Guarantee

All our products benefit from legal guarantee of conformity and hidden defects provided by articles 1641 and following of the Civil Code. In case of non-compliant product, it may be returned, exchanged or refunded.

All claim requests for exchange or refund must be made by email or telephone within 7 days after delivery. Products must be returned to us in the state which you received with all elements (accessories, packages, instructions, etc.). Shipping costs will be your expense and several supporting documents may be required to complete the full refund.

The provisions of this Article do not prevent you from the right of withdrawal provided in Article 6.

Article 10 - Liability

Products are offered in accordance with French legislation. Mike Services cannot be responsible for legislation of the country where the product is delivered in case of non-compliant product. It is your responsibility to check with local authorities for importing or using the products that you intend to order.

Moreover, Mike Services cannot be held responsible for damages resulting from misuse of purchased products.

Finally, Mike Services cannot be held liable for any inconvenience or damage inherent to the use of internet, including a break in service, external intrusion or the presence of computer viruses.

Article 11 - Applicable law in case of disputes

The language of this contract is English. These sale conditions are subjects to French law. In case of dispute, French court will be the only competent.

Article 12 - Intellectual property

All elements of https://mike-services.com website are the exclusive intellectual property of Mike Services. No one is authorized to reproduce, exploit, rebroadcast, or use for any reasons even partial elements of our website that are software, visual or sound. Any single or hypertext link is strictly prohibited without the written consent of Mike Services.

Article 13 - Personal Data

Mike Services reserves the right to collect personal information and personal data of our clients. We use these necessary details to manage your order, as well as to improve the services and information. They can also be forwarded to companies that contribute to these relationships, such as those responsible for execution, processing and payment.

The records of Mike Services will be considered by all parties as a proof of communications, orders, payments and transactions between all parties.
